This document is published in compliance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which mandates the publication of rules, regulations, privacy policy, and terms of use for access or usage of the domain name [www.BikeDilwado.club] (the "Website"), including its related mobile site and mobile application (collectively referred to as the "Platform").

The Platform is owned and operated by Wheels of Freedom Private Limited, a company incorporated under the Companies Act, 1956, with its registered office at 538/ka/39 Triveni Nagar 1st, Sitapur Road, Lucknow ("BikeDilwado").

By accessing, browsing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms of Use"). If you do not agree with any part of these Terms of Use, you may not access or use the Platform. These Terms, along with applicable policies, govern the use of the Platform and constitute a binding agreement between you and BikeDilwado.

1. User Eligibility

Transactions on the Platform are available only to persons who can legally contract under the Indian Contract Act, 1872. Minors under 18 years of age may use the Platform only under the supervision of a parent or legal guardian. BikeDilwado reserves the right to terminate any account if it is discovered that a minor is transacting without supervision.

2. User Account and Responsibilities

Users are responsible for maintaining the confidentiality of their login credentials. Any unauthorized use of the account is the sole responsibility of the user. In case of any inaccuracies in account information, BikeDilwado reserves the right to suspend or terminate the account.

3. Platform for Transactions and Communication

The Platform serves as an intermediary for users to engage in transactions. BikeDilwado is not a party to any agreement between buyers and sellers and does not control or influence commercial terms. All commercial terms, including pricing, warranties, and after-sales services, are agreed upon solely between buyers and sellers.

4. Features and Benefits on Vehicles

  • Vehicle Inspection: All vehicles undergo a 107-point check, covering engine condition, documentation, and overall quality.

  • Exchange Policy: Easy exchange within 3 days or 100 km (whichever comes first).

  • Guaranteed Paper Transfers: Ensuring legal compliance in ownership transfers.

  • Complimentary Benefits: Includes insurance and pollution certification.

  • Warranty on Engine and Gearbox:

    • Manufacturing Year 2020 & above: 6 months or 1,000 km (whichever comes first).

    • Manufacturing Year 2015-2019: 3 months or 500 km (whichever comes first).

  • Buy-Back Policy:

    • Depreciation depends on vehicle age and usage.

    • Vehicles older than 2 years are subject to re-evaluation.

Note: Vehicles manufactured in 2014 and earlier are not covered under warranties or buy-back policies. Regular servicing at authorized service stations is mandatory to avail of warranty and buy-back benefits.

5. Communications

By using the Platform, you consent to receive communications, including:

  • Transactional updates

  • Payment requests

  • Service-related notifications

  • Promotional offers

6. Order Processing and Cancellations

  • Orders placed are an offer by the buyer and may be canceled at the seller’s discretion.

  • Refunds, if applicable, will be processed in accordance with the seller’s policies.

  • BikeDilwado is not responsible for delays, stock shortages, or unsatisfactory performance of sellers.

7. Liability and Indemnification

Users agree to indemnify BikeDilwado against any claims arising from their use of the Platform. The Platform disclaims liability for any losses or damages incurred due to fraudulent transactions, incorrect information, or any third-party service provider failures.

8. Amendments and Updates

BikeDilwado reserves the right to modify these Terms of Use at any time without prior notice. Users are responsible for regularly reviewing the Terms to stay informed of updates.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with Indian law. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Lucknow, India.
